By downloading or using HighPER Sleep, you agree to these terms. Please read them carefully. If you don't agree, don't use the app.
These Terms of Service ("Terms") form a binding agreement between you and Milan Zwiauer ("we," "our," "us"), the operator of HighPER Sleep.
You may use HighPER Sleep for your own personal, non-commercial purposes. You agree not to:
To use HighPER Sleep you sign in with Apple, Google, or email. You are responsible for keeping your sign-in credentials secure. You must be at least 16 years old to use the service.
You can delete your account at any time from the Settings screen. Deletion is permanent and erases all your data within 30 days.
HighPER Sleep offers a free tier and a paid Premium tier. Premium unlocks the App Blocker, full sleep analytics, cycle predictions, and other features described in the in-app paywall.
All payments are processed by Apple via the App Store. We never see or store your payment card details. Pricing in your local currency is displayed in the App Store before you confirm a purchase.
Prices may change. Existing subscribers will be notified before any price increase takes effect.
New users may be offered a 3-day free trial. At the end of the trial, your subscription automatically renews at the full price unless you cancel at least 24 hours before the trial ends.
Your subscription continues until you cancel. Cancelling before the end of the current billing period keeps your Premium features active until that period ends; no partial refunds are issued.
Apple handles all refunds for App Store purchases. To request a refund, visit reportaproblem.apple.com. We do not have the ability to issue refunds directly.
To cancel auto-renewal: open Settings → [Your Name] → Subscriptions → HighPER Sleep → Cancel Subscription.
The information, recommendations, and predictions provided by the app — including cycle-phase predictions, sleep advice, and recovery suggestions — are for general informational purposes only. They are not medical advice and are not a substitute for diagnosis, treatment, or recommendations from a qualified healthcare professional.
Do not rely on the app's cycle predictions for contraception or family planning. Cycle predictions are statistical estimates based on your logged data and can be wrong.
If you have a sleep disorder, hormonal condition, mental health concern, or any other medical issue, consult a qualified healthcare provider. In a medical emergency, contact emergency services.
HighPER Sleep, the HighPER brand, the sprout mascot, the app design, and all related content are our intellectual property. You receive a personal, non-exclusive, non-transferable, revocable licence to use the app according to these Terms — nothing more.
Your data (sleep logs, cycle entries, etc.) remains yours. You grant us a limited licence to store, process, and analyse it solely to deliver the service to you, as described in our Privacy Policy.
To the maximum extent permitted by law, HighPER Sleep is provided "as is" and "as available" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.
Our total aggregate liability for any claim arising from these Terms or your use of the app is limited to the amount you paid us in the 12 months preceding the claim, or USD 50, whichever is greater.
Nothing in these Terms limits liability that cannot be limited under applicable law.
You can stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these Terms, attempt to defraud us, or use the app in ways that harm us or other users.
On termination, your right to use the app ends immediately. Provisions that should reasonably survive termination (such as intellectual property, liability limits, and governing law) will continue to apply.
We may update these Terms occasionally. Material changes will be announced in-app at least 30 days before they take effect. Continued use of the app after changes constitutes acceptance.
These Terms are governed by the laws of Switzerland, without regard to its conflict-of-laws principles. Any disputes will be resolved in the courts of Basel, Switzerland, except where mandatory consumer-protection law requires otherwise.
